BUILT IN FIVE is offered for business purposes only. By purchasing a build, you confirm that:
- you are acting wholly or mainly for business purposes;
- you have authority to enter into the agreement yourself or on behalf of the business you represent; and
- the project is not being purchased primarily for personal, family or household use.
If this is not the case, do not purchase a build without speaking to us first.
What you're buying
BUILT IN FIVE is a fixed-scope product design and development sprint. The service includes the product thinking, design and technical development reasonably required to deliver the product described in your agreed Build Summary. Depending on the project, this may include:
- product definition and scoping;
- UX and user flows;
- UI design;
- software development;
- database and application architecture;
- integrations;
- AI functionality;
- testing and QA;
- deployment or technical handover; and
- reasonable documentation required to operate the delivered product.
Not every project requires every item above. Your Build Summary defines what we're actually building for you.
Your Build Summary
Before you pay, we'll agree a Build Summary with you. This is the important bit.
Your initial idea can be as large, ambitious or loosely defined as you like. Our job is to turn it into a focused product that can realistically be built during the five-day sprint. The Build Summary records the version we're agreeing to build. Once accepted by both sides, it becomes the agreed scope of the project.
If your original idea contains functionality that isn't included in the final Build Summary, that functionality isn't part of the five-day build.
Five days means focus
We aren't promising to compress twelve months of software development into five days. We are promising to use professional product judgement to identify the strongest complete version of your idea that can reasonably be delivered during the sprint.
That may mean prioritising some functionality and leaving other ideas for later. Scope is part of the service.
The five-day build
Your build begins on an agreed Build Start Date. The Build Start Date counts as Day 1. We then have five consecutive working days to deliver the agreed build.
For these terms, a "working day" means Monday to Friday, excluding public and bank holidays in England. Unless agreed otherwise, weekends don't count towards the five-day build.
You need to be available too
Five days only works if both sides can move quickly. During the build, you agree to remain reasonably available and provide things we reasonably need, including decisions, feedback, copy or content, branding, credentials, API access, existing code, data, third-party accounts and approvals.
If we're delayed because we're waiting for something from you, the delivery timetable is paused or extended accordingly. We aren't responsible for missing the original delivery date where the delay was caused by information, access, decisions or materials we were waiting to receive from you.
Changes during the build
Small decisions, refinements and adjustments are a normal part of building a product. We'll make reasonable product and design decisions during the sprint to deliver the agreed outcome.
A material new feature, integration, workflow or change of direction that falls outside the Build Summary is not automatically included. If you want to materially change the agreed product after the build has started, we can either:
- substitute it for other agreed scope where practical; or
- treat it as additional work to be agreed separately.
Delivery
Delivery means making the completed build available to you in the form agreed in the Build Summary. Depending on the project, that might mean deployment to a live environment, access to a working application, transfer of a source-code repository, transfer of project files, access to infrastructure, or another agreed form of technical handover.
Third-party approval processes aren't under our control. For example, if a product requires Apple, Google, Meta, a payment provider or another third party to review or approve something, submitting a completed product for that process may constitute delivery where the approval itself is outside our control.
Your five days of support
After delivery, you receive 5 consecutive working days of design and technical support. Unless otherwise agreed, the support period begins on the first working day after delivery.
Support includes reasonable bug fixes, technical assistance, deployment assistance, correction of functionality that doesn't materially conform to the Build Summary, and minor design or UX refinements to the delivered product.
Support does not include major new functionality, significant redesigns, new products, additional platforms, substantial new integrations, or functionality outside the agreed Build Summary. Those can be quoted separately if required. Unused support days don't roll over.
Price and payment
The price of one BUILT IN FIVE project is £10,000 plus VAT where applicable. The applicable total will be shown before payment.
Unless we agree otherwise in writing, payment is due in full before your Build Start Date is confirmed. A build slot isn't secured until we have accepted the project and payment has been successfully received.
Only five builds
BUILT IN FIVE is a deliberately limited offer. Only five paid projects will be accepted under this specific £10,000 / five-day offer. Once all five have been booked, the offer closes.
Submitting an idea, speaking to us or receiving a Build Summary doesn't itself reserve one of the five places. A place is taken when the project has been accepted and the required payment has cleared.
Cancelling your build
Because this is a bespoke professional service and capacity is deliberately limited, please only book when you're ready to proceed.
If you cancel before the Build Start Date, we'll refund the amount paid less reasonable work already carried out specifically for your project, and any non-refundable third-party costs we've incurred for your project.
Once the Build Start Date has begun, the fee is non-refundable except where we agree otherwise in writing; we materially breach this agreement and don't remedy that breach within a reasonable opportunity to do so; or a refund is otherwise required by law.
If we decide that we can't proceed with your project before work starts, we'll refund any project fee you've paid.
If we are late
The five-day commitment assumes that the agreed scope doesn't materially change; you provide required information and decisions promptly; necessary third-party systems remain available; and circumstances outside our reasonable control don't prevent delivery.
If delivery is delayed for reasons solely within our reasonable control, we'll continue working to complete the agreed Build Summary without charging you extra for that delay. If a material delay becomes unreasonable, we'll discuss an appropriate remedy with you, which may include cancellation and a proportionate refund for services not delivered.
Bugs versus new features
Software development is iterative. A bug is functionality included in the Build Summary that materially doesn't operate as agreed. A request to add functionality, change the product direction or alter behaviour that wasn't included in the Build Summary is a change request, not a bug.
Where a material bug is reported during the included support period, we'll use reasonable efforts to correct it.
Ownership
Once we've received full payment, you own the bespoke work created specifically for your project, including bespoke source code and designs, subject to the exceptions below.
We retain ownership of tools we already owned, know-how, methodologies, development techniques, generic or reusable components, internal tooling, templates, and technology that wasn't created specifically and exclusively for your project. Where those materials are incorporated into your product, you receive the rights reasonably necessary to use the delivered product.
Open-source software and third-party technology remain subject to their own licences and terms.
Third-party services
Your product may use third-party services such as hosting, cloud infrastructure, domain providers, databases, AI providers, payment processors, email providers, APIs, app stores or analytics services. We'll integrate these where they're part of the agreed Build Summary.
Unless expressly stated otherwise, ongoing subscription, hosting, API, transaction, licence and usage charges after delivery are your responsibility. We aren't responsible for failures, outages, policy changes or discontinuation of services operated by third parties outside our control.
Confidentiality
We understand that you may be sharing an idea that hasn't been launched publicly. We'll treat non-public information you provide about your product, business, technology and plans as confidential and use it for the purpose of evaluating, designing and delivering your project. You agree to do the same with non-public information we provide to you.
This doesn't apply to information that is already public through no breach of these terms, was already lawfully known, is independently developed, or must legally be disclosed.
We won't publicly identify your project or use it as a case study without your permission.
AI and development tools
We may use professional software-development, AI, design, testing and cloud tools when creating your product. This may include using AI to help structure your original idea, assist development, test software or accelerate parts of the build. We remain responsible for delivering the agreed service.
We won't knowingly use your confidential information for purposes unrelated to evaluating or delivering your project. Personal information is handled in accordance with our Privacy Policy.
What you give us
You confirm that you have the right to provide and allow us to use any text, images, trademarks, branding, datasets, source code, designs, credentials, documentation or other material you supply for the project.
You're responsible for ensuring that your product, business model and materials are lawful. You must not ask us to build something that is unlawful, fraudulent, infringing or intended to cause harm. We can refuse or stop work on a project where we reasonably believe continuing would create a legal, security or serious ethical issue.
Regulated products
Experience in banking, financial services, SaaS or other regulated industries doesn't mean we're providing legal, financial, regulatory, tax, medical or other professional advice. If your product operates in a regulated area, you're responsible for obtaining appropriate specialist advice and determining the rules that apply to your business.
Unless regulatory or compliance work is expressly included in the Build Summary, it isn't part of the service.
No promise of commercial success
We'll provide the service with reasonable professional skill and care. We don't guarantee that your product will make money, attract users, raise investment, be accepted by an app store or third party, receive regulatory approval, achieve a particular valuation, generate a particular commercial outcome, or succeed as a business.
We're building the product, not guaranteeing what the market does with it.
Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence. Subject to that:
- neither party will be liable to the other for indirect or consequential losses; and
- neither party will be liable for loss of profit, revenue, anticipated savings, opportunity or goodwill arising indirectly from the project.
Our total aggregate liability arising from a BUILT IN FIVE project will not exceed the total project fee actually paid to us for that project.
You should maintain appropriate backups of any existing systems or data before allowing them to be modified or migrated.
Events outside our control
Neither side is responsible for delay caused by circumstances genuinely outside its reasonable control. This can include major failures of third-party infrastructure, widespread internet or cloud outages, natural disasters, government action or similar events.
We'll tell you as soon as reasonably practicable if such an event materially affects your build.
Ending the agreement
Either side can terminate the agreement if the other commits a material breach and, where that breach can reasonably be fixed, doesn't fix it after being given a reasonable opportunity.
We may also terminate immediately where continuing the project would reasonably expose us to unlawful activity, sanctions, infringement, fraud or serious security risk. Termination doesn't affect rights or obligations that arose before termination.
The agreement between us
The agreement for your project consists of:
- these Terms;
- your agreed Build Summary;
- any written variation agreed by both sides; and
- our Privacy Policy where personal data is concerned.
If there is a conflict between the Build Summary and these general Terms about the specific product being delivered, the Build Summary takes priority for that project. Neither side relies on promises that aren't included in the agreement.
Changes to these terms
We may update these Terms for future projects. The version that applies to your build is the version you accepted when your project was booked. We won't retrospectively change the terms of an already confirmed build without your agreement.
Governing law
These Terms and each BUILT IN FIVE project are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over disputes arising from them.
